Is online betting legal in New York?

Yes, online betting became legal in New York state on January 8, 2022. Any American physically located within the state can join a sportsbook and bet, even without living in the state.

Are online casinos legal in New York?

No. Despite multiple attempts to change legislations, online casinos are still illegal in New York. Social Casinos have been a legal alternative, but new legislations have banned them from the state.

Did New York ban sweepstakes?

Yes. On December 5, 2025, Governor Kathy Hochul signed bill S 5935, effectively banning sweepstakes casinos and sportsbooks using dual currency systems or offering real money prizes. So what does this mean for players?

Technically, social and sweepstakes brands may still operate legally in New York. But they can only allow free-to-play services, no redeemable sweep coins, and no cash prizes. Many of the brands have decided to leave New York because of this, as restructuring their sites/apps for one state might be unprofitable.

Is fantasy sports and prediction allowed in NY?

Yes. The sweepstakes law bans social/sweepstakes casinos and sportsbooks using a dual currency system and cash prizes. It does not specifically target DFS, Pick'em or prediction markets. As long as they are operating within NY state laws, these platforms are still available.

What's the legal betting age in New York?

In New York the legal age to join and play at online sportsbooks is 21+. For other types of gambling, such as horse racing and lottery tickets, the requirement is 18+.

Do I have to pay taxes on sportsbook winnings in NY?

Online sportsbooks and betting were legalized in New York on January 8, 2022. The Empire State is known for its love of football, which is no wonder with popular teams like the Bills and the Giants, and quickly became one of the quickest growing betting markets in the United States. The legalization also brought with it a surge in tax revenue that has boosted fundings to public services immensely.

Originally, nine online sportsbooks were given a license to operate in New York. Since then, some have temporarily and permanently leave the market, and one license changed ownership. At the moment there are eight legal sportsbooks in New York:

New York Social Sportsbooks

Social Sportsbooks in New York were legal for a long time, but a big change was implemented recently. In December 2025, a bill was signed that bans sweepstakes platforms using a dual currency system and real money prizes. Brands may continue to operate in the state, by only with free-to-play games and no redeemable cash prizes. For this reason, most brands chose to leave the state.

New York Online Casinos

Online casinos are illegal in New York state. Multiple attempts have been made to legalize and regulate online casinos, including in 2025, but so far the attempts have seen little support. It remains unlikely that internet casino games will be legal in New York any time soon.

New York Social Casinos

As online casinos have always been illegal in New York, Social Casinos have become extremely popular. But as New York Senate Bill S5935A was unanimously approved and later signed by the governor, sweepstakes casinos have been severely restricted. Being no longer able to accept real money via dual currency, most social casinos have left New York.

Former sportsbooks in New York

ESPN BET did not really leave New York, but after terminating the partnership with ESPN, the sportsbook rebranded and launched again as theScore Bet.

WynnBET was one of the original nine licensed sportsbooks that went live when online betting was legalized in New York. In 2024, WynnBET exited multiple US states, including New York in July, which ultimately led to ESPN Bet purchasing their NY license.

Bally Bet also left the market briefly for a period of five months in June 2023, after which they relaunched their New York operations again with a new tech platform.

Resorts World Bet exited New York in June 2025 following problems establishing a presence on the market.

Betting in New York while from another state

According to US law, you do not have to be a resident of a state in order to gamble while inside its borders. This goes for both online and physical gambling. Keep in mind however that while gambling in another state you may have to submit a nonresident tax form as well as report it on your normal tax return. Some states offer credit to avoid double taxation from income already taxed in another state.

It is not possible nor legal for a New York resident to play at a NY sportsbook while in another state. It is however possible for a visitor to the state to play at a NY betting site. Visitors will have to submit a New York nonresident tax return form called IT-203 and report their winnings.
