What is DFS?

Daily Fantasy Sports, commonly referred to as DFS, blends prediction with statistics to create a game where users draft a virtual team using real-life athletes, and compete against other users. When a team is put together, users make player-based predictions such as over/under on specific stats. The results of the virtual athletes are directly tied to the performance of the actual athletes, so thinking strategically when building a line-up is essential. 

The length of fantasy player props can vary, but most contests last between a day and a week. The scoring system is based on how many predictions the user managed to hit, and how far their team made it in the competition. What is Pick'em?

Pick'em, also known as Player Prop-Style Fantasy, is a smaller and simpler format. Pick'em doesn't require users to create a full team, but rather lets them keep it simple by sticking to 2-6 picks, and selecting over/under stats for them. The payout charts reward bigger prizes depending on how many of the athletes' performances that were predicted correctly. 

Some states consider Pick'em to be more similar to traditional betting than DFS, as there are some similarities to player prop parlays. For this reason, a few states have started regulating or prohibiting Pick'em. This means that depending on the state, Pick'em might be banned even though fantasy apps are legal.

One of the most notable things about Daily Fantasy Sports and Pick'em sites is that they are available in many US states where traditional betting is illegal. The way this is possible is that they aim to eliminate one of the three core elements that define gambling according to US law. These are Consideration, Chance and Prize. In fantasy, "chance" is removed.

The motivation is that fantasy contests are not a game of chance, but rather a game of skill. DFS and Pick'em apps are very skill-focused, with users analyzing players, teams, venues and anything that could possibly affect outcomes and results. The best fantasy and pick'em users usually spend a lot of time analyzing this type of data before picking their players, and the more skillful user normally wins.

Can you win real money on DFS and Pick'em?

Yes, you can make real money playing DFS and Pick'em, but not in every state. Fantasy sports are considered a game of skill, not luck, which makes it possible to compete for real cash in most states. A few states have specifically banned real-money rewards and paid entry contests, but users can often play for free regardless.

The classical way to make real money on fantasy sports is to join a paid entry contest or tournament. The admission is normally up to $10 dollars, and the total prize pools can range from a few thousands up to hundreds of thousands of dollars, with 1st place paying out $10,000 dollars or more. Some plattforms also offer smaller head-to-head competitions and cash-games, with fewer participants and smaller prizes. Pick'em apps usually have smaller flex competitions with prizes of 5-10 times the entry cost.

In what states is DFS & Pick'em legal?

Fantasy sites in some form are legal in about 35-45 states, but it's difficult to pinpoint an exact number. There is no federal law in the US that regulates DFS and pick'em, which makes it a matter of state regulation. Some states have introduced specific legislations for DFS operators, but in most the subject has been more or less ignored, simply making it legal because there is no law against it. 

Some states have introduced stricter oversight and licensing systems for fantasy websites, while some prohibit paid-entry contests, cash prizes or other functions that involve real money, choosing to treat it as gambling. There are states that allow DFS but not Pick'em, or vice versa.
